Draft — needs legal review.
This text is a working draft and is not yet in effect. It will be replaced after review by counsel.
These terms are an agreement between your business (“you” or the “shop”) and [Rinsely legal entity — TBD] (“Rinsely”) for use of the Rinsely dashboard, apps and booking sites.
1. The service
Rinsely provides software for running a detailing business: online booking, scheduling, job records, customer messages, payment processing through a provider you choose, and reports. Features may change over time.
2. Accounts
You are responsible for your account, for the staff you invite, and for keeping passwords private. You must be authorized to act for the business you sign up.
3. Subscription and fees
You pay the subscription for your plan as shown on the pricing page or in your order. Rinsely takes no fee on payments you take through Rinsely. Card processing fees are charged by the payment provider: on Rinsely Payments, Stripe's standard rate passed through at cost; on Bring Your Own Hardware, your Square account's rate.
4. Payments
Card payments are processed by Stripe or Square under their own terms, which you accept when you connect an account. Rinsely is not a bank or money transmitter and does not hold your funds. You are responsible for refunds, disputes and chargebacks with your customers.
5. Your data and your customers
You own the data you put into Rinsely. You give Rinsely permission to host and process it to provide the service, as described in the privacy policy. You are responsible for having the right to contact your customers, including consent for text messages where required.
6. Acceptable use
Do not use Rinsely to send spam, to break the law, to access another shop's data, or to interfere with the service.
7. Availability and changes
We work to keep Rinsely available but do not guarantee uninterrupted service. We may update the service and these terms; we will give notice of material changes.
8. Cancellation
You can cancel at any time. We may suspend accounts that break these terms or do not pay. After cancellation, you can request an export of your data for a limited period.
9. Disclaimers and liability
The service is provided “as is” to the extent the law allows. Rinsely's liability is limited to the fees you paid in the 12 months before the claim.
10. Governing law
[Governing law and venue — TBD by counsel.]
